The owner of the pit shall make it good, and give money unto the owner of them; and the dead beast shall be his.
The owner of the pit must pay the owner for the loss; the dead animal will become the property of the person who opened the pit. The compensation structure is clean: the negligent party compensates the victim and receives the dead animal as partial return. The transfer of the dead animal to the party at fault prevents double loss while maintaining the compensation obligation.
